Hey Blue! The Ask the Expert Subscription Services

Includes

  1. 10 emailed questions per calendar month to Blue Cirrus Consulting (no rollover)
  2. Follow-up questions are considered a new question.
  3. Access to The Knowledge Base of previously asked questions or other additional industry information is available with the purchase of 3 months or more.

The information provided by Blue Cirrus Consulting and its representatives does not, and is not intended to, constitute legal advice on any subject matter.

Questions requiring research and or conversations with a consultant will require a separate contract and will be communicated to the client.

Initial questions must be no longer than 1,000 characters, including spaces (about 200 words) and must be posted in the initial space provided. Longer questions that exceed the automatic limit or that are continued in a second comment window will be deleted without reply.

We do not allow any questions or comments that are repetitive, nor do we permit the use of any language that is abusive, harassing, or hateful. Such questions will be deleted, and no refund will be provided.

Nothing in these Terms shall be interpreted as giving the Users/ Users any rights in Blue Cirrus Consulting intellectual property rights or any other intellectual property used in connection with the Initiative, websites, platforms, logos, brands, trademarks, etc.

YOU MAY NOT ACCESS OR USE HEY BLUE! THE ASK EXPERT SERVICE (OR ANY PART THEREOF) IF YOU DO NOT AGREE TO THESE TERMS, DO NOT HAVE THE REQUISITE AUTHORITY, OR DO NOT MEET THE ELIGIBILITY REQUIREMENTS SET FORTH IN SECTION BELOW.

ELIGIBILITY. You must be at least 18 years old or the age of majority in your jurisdiction to create an account to use The Ask the Expert Service. You affirm and represent and warrant that you are 18 years of age or older and fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.

CONFIDENTIALITY AND PROPRIETARY INFORMATION.  Information provided to Blue Cirrus by the Client during the course of this Agreement, including, but not limited to, trade secrets, suppliers, mailing lists, system data, trademarks, manuals, copyrighted materials, patents, know-how, business methods, processes, accounts, customers, clients, vendors and financial information of the Client (“Client Information”) shall be treated as confidential at all times by Blue Cirrus and shall not be disclosed to anyone else without prior written approval of the Client.

MODIFICATIONS TO THESE TERMS. Blue Cirrus Consulting reserves the right to update or modify these Terms and/or any Additional Terms at any time.

FEES; PAYMENT TERMS

Fees for Hey Blue! The Ask the Expert Payment Terms. The current fee structure and all fees associated with Hey Blue! The Ask the Expert Service are available at www.blue-cirrus.com. The fees payable by you in connection to your use of Hey Bue! The Ask the Expert Subscription Service shall be set forth in the applicable electronic or written order (each, an “Order”) submitted by you to obtain access to Hey Blue! The Ask the Expert Subscription. You agree to, and shall, pay Blue Cirrus Consulting, and hereby authorize Blue Cirrus Consulting and its third-party processors to charge you, the fees, charges and taxes, specified in the Order submitted by you to Hey Blue! The Ask the Expert Service for access to Hey Blue! The Ask the Expert Service, in accordance with the payment terms specified therein. You will be asked to supply certain information relevant to your Order including, without limitation, your credit card number, the expiration date of your credit card (and CCV#), your billing address, and/or your shipping information. You represent and warrant that you have the legal right to use any credit card(s) or other payment method(s) provided by you in connection with any Order. Verification of your information may be required prior to the acknowledgment or completion of any Order.

Cancellation. Except as otherwise expressly set forth, or as required by law, all purchases of The Ask the Expert Subscription Service are final and non-refundable.

Changes to Fees & Payment Terms. We may at any time and from time to time, in our sole discretion, change the fees, pricing models, charges, and/or payment terms. New fee terms and/or pricing will not change until your current subscription period is exhausted.

AVAILABILITY OF THE ASK THE EXPERT SERVICE. Hey Blue! The Ask the Expert Service is operated by Blue Cirrus Consulting in the United States. Hey Blue! The Ask the Expert Service is intended for users who reside in the United States of America. Information describing Hey Blue! The Ask the Expert Service may be accessible worldwide, but this does not mean Hey Blue! The Ask the Expert Service, or certain portions thereof, are available in your country. If you access and use Hey Blue! The Ask the Expert Service outside the United States, you do so at your own risk and are responsible for compliance with applicable local laws. Blue Cirrus Consulting may restrict access to Hey Blue! The Ask the Expert Service, or portions thereof, in certain countries in its sole discretion. It is your responsibility to make sure your use of Hey Blue! The Ask the Expert Service is legal in your country of residence. Hey Blue! The Ask the Expert Service may not be available or accessible in all languages.

 

GOVERNING LAW.  This Agreement shall be governed and construed in accordance with the laws of the State of South Carolina, without regard to conflicts of law principles. The Parties hereby agree that the courts of the State of South Carolina shall have sole and exclusive jurisdiction over any matter arising from the interpretation, purpose, effect, or operation of this Agreement or any Statement of Work related to this Agreement regardless of the residence, now or in the future, of any Party.  The Parties consent to venue in Greenville County, South Carolina, and waive any rights they may have to assert jurisdiction or venue in any other court, administrative forum, or other adjudicative body.  If mutually agreed by both parties, disputes may be adjudicated through binding arbitration by a qualified third party such as the American Arbitration Association.
